| GD California, Inc. warrants
to the original purchaser that the products delivered herewith will
be free from defects in material and workmanship under normal installation,
use, and service for the warranty period of ninety (90) days from
the date of the original shipment thereof to the purchaser. During
the warranty period, the obligation of GD California under this limited warranty
shall be limited to, at GD California's option, the repair or replacement of
products which prove to be defective.
This limited warranty does not apply to, and is void with respect
to, defects or damage to such products which result from the abnormal
use or operation of the products, or from abuse, neglect, misuse,
or accident, or defects in any product which has been altered or
which has been serviced or repaired by someone other than GD
California or
its authorized representative. The purchaser shall, upon request
by GD California, furnish reasonable evidence that the defect for which warranty
service is requested arose from and in the normal use of the product.
Except as set forth below, in all cases of warranty, repair, or
service, products must be returned to GD California for warranty service.
Transportation must be prepaid on any such return and also for the
return of the products to the purchaser.
THIS WARRANTY IS LIMITED TO THE
REPAIR OR REPLACEMENT OF THE PRODUCT. THERE IS NO OTHER WARRANTY.
THIS WARRANTY IS IN LIEU OF ANY AND ALL OTHER WARRANTIES, OBLIGATIONS,
OR LIABILITIES EXPRESSED OR IMPLIED. GD CALIFORNIA HEREBY DISCLAIMS ALL WARRANTIES
OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. GDC SHALL
HAVE NO LIABILITY FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL
INJURY, LOSS, OR DAMAGE OF ANY KIND OR NATURE.
