a. CUSTOMER IS PURCHASING THE
EQUIPMENT “AS IS, WHERE IS” AND “WITH ALL FAULTS”. b.
THE EQUIPMENT IS SURPLUS
EQUIPMENT AND MAY BE USED, NON-OPERATIONAL, INCOMPLETE OR OTHERWISE
DEFECTIVE. GD CALIFORNIA, INC. WILL
REPLACE OR REFUND IF EQUIPMENT IS FOUND TO BE NON-FUNCTIONAL WITHIN 30 DAYS OF
SHIPMENT. c.
GD CALIFORNIA, INC. MAKES NO
REPRESENTATIONS OR WARRANTIES TO CUSTOMER REGARDING THE QUALITY, NATURE,
CONDITION OR COMPOSITION OF THE EQUIPMENT OR REGARDING THE COMPLIANCE OF THE
EQUIPMENT WITH THE REQUIREMENTS OF ANY SPECIFICATIONS, LAWS OR REGULATIONS. d.
CUSTOMER IS SOLELY RESPONSIBLE
FOR THE SELECTION OF THE EQUIPMENT, ITS ABILITY TO ACHIEVE THE RESULTS CUSTOMER
INTENDS, ITS USE WITH CUSTOMER’S SOFTWARE AND PERIPHERALS, AND THE PERFORMANCE
